This Privacy Policy explains how Renny Newyork Inc ("we", "us", "our"), which operates the website at eternate.com (the "Site"), collects, uses, shares, and protects your personal information when you visit the Site, contact us, or make a purchase.
Who is responsible for your data: Renny Newyork Inc, 98 Cuttermill Road, Suite 466, Great Neck, NY 11021, United States. Email: service@eternate.com
This Site is operated from the United States and primarily serves US customers. If you visit from the European Economic Area (EEA) or the United Kingdom, the "Your rights in the EEA and UK" section below also applies to you.
Device information. Browser type and version, IP address, time zone, cookie data, the pages and products you view, search terms, and how you interact with the Site. Collected automatically via cookies, log files, web beacons, tags, and pixels, to load the Site correctly and analyse usage. Shared with our platform provider, Shopify.
Order information. Name, billing and shipping address, payment information (including card details), email address, and phone number. Collected from you to process and fulfil your order, take payment, arrange shipping, send invoices and order confirmations, communicate with you, and screen for fraud. Shared with Shopify and with our payment, shipping, and fraud-prevention providers as needed to complete your order.
Customer support information. Any information you provide when you contact us for support, including your name, contact details, and details of your enquiry. Where you give us your email address or mobile number and agree to be contacted, we also keep a record of that consent (including its date, time, and method) so we can communicate with you about your orders and enquiries.
Chat information. If you use the chat assistant on our Site, we record the messages you exchange with it, along with technical information about your session. These conversations are processed by our customer service providers, including OpenAI, to operate the assistant and respond to you, and we keep them as part of our customer support records. By using the chat assistant, you consent to this recording and processing.
Loyalty program information. If you join our loyalty program, we collect purchase history, preferences, and any details you choose to give (such as date of birth) to run the program, award points, set tiers, and provide rewards. Participation is voluntary and you can opt out or request deletion at any time.
We use the contact details you give us, such as your email address and mobile phone number, to communicate with you about your orders and your customer-support enquiries, for example order confirmations, shipping updates, and replies to questions you raise. Message and data rates may apply to messages we send, and message frequency varies. Where messages are sent by text, you can opt out at any time by replying STOP, or reply HELP for assistance. You can opt out of emails using the unsubscribe link they contain.
We share certain contact details, such as your email address, name and address, with our advertising partners, usually in hashed (encoded) form, to show you relevant ads and measure how our advertising performs. This is described in "Targeted advertising" below, and you can opt out at any time. Mobile phone numbers and consent collected for text messaging are not shared with third parties or affiliates for their marketing or promotional purposes.
We use your personal information to provide products and services, process payments, ship and fulfil orders, communicate with you and provide customer support, run our loyalty program, detect and prevent fraud, and comply with our legal obligations. Where permitted, we also use it to send you information about products, services, and offers.
We share personal information with service providers who help us run our business, and only as needed for them to perform their services. These include:
We may also disclose personal information to comply with applicable law, respond to a lawful request (such as a subpoena or warrant), or protect our rights.
If we are involved in a merger, acquisition, financing, reorganisation, bankruptcy, or sale of all or part of our business or assets, your personal information may be transferred as part of that transaction. Any recipient will be required to handle it in line with this Privacy Policy.
When you use the Site, the following companies receive information such as your IP address, device information, the pages you view, and identifiers stored in cookies, for the purposes below. For visitors in the EEA and UK, the advertising and analytics services below only run if you consent, and you can change your choice at any time via "Cookie Settings" in the footer.
We use some personal information to show you advertising that may interest you, including through Google Analytics (https://policies.google.com/privacy) and other advertising partners. Depending on your state, this activity may be considered "targeted advertising", a "sale", or "sharing" of personal information under applicable law.
In addition to information collected through cookies and pixels, we share certain contact details, such as your email address, name and address, usually in hashed form, with advertising partners. We do this through direct connections from our store and through customer list uploads, so that our partners can match you to your accounts on their platforms, show you relevant ads and measure our advertising. Opting out through cookie settings stops browser-based sharing for that browser. To stop the sharing of contact details linked to you, use the form on our "Do Not Sell or Share My Personal Information" page.
You can opt out at any time in any of these ways:
We do not require you to create an account or verify your identity to opt out. We process opt-out requests within 15 business days and pass them on to the third parties we have sold or shared your information with, as required by law.
Personal information we collect, use, and disclose. In the past 12 months, we have collected the categories of personal information below. We collect them from you directly, automatically from your device when you use the Site, and from our service providers (such as payment and fraud-prevention providers). We use them for the purposes described in "How we use your information," and we disclose every category to our service providers for those business purposes.
Sensitive personal information. We use sensitive personal information only to process payments, provide access to your account, prevent fraud, and as otherwise permitted by law. We do not use or disclose it to infer characteristics about you.
Your rights. Depending on your state of residence, you may have the following rights. This includes, but is not limited to, California, Colorado, Connecticut, Texas, Virginia, and other states with comprehensive consumer privacy laws.
How to exercise your rights. Contact us at service@eternate.com. You may use an authorised agent to submit a request on your behalf. We will take reasonable steps to verify your identity before responding, and we will respond within the timeframe required by your state's law.
Appeals. If we decline your request and your state provides a right to appeal, you may appeal by contacting us at service@eternate.com.
Loyalty program (financial incentive notice). Our loyalty program may be considered a financial incentive under California law. Participation is voluntary and you may withdraw at any time. Any difference in price or service is reasonably related to the value of the data you provide.
If you are in the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) or UK GDPR gives you the right to access, correct, update, port, or erase your personal information, to restrict or object to certain processing, and to withdraw consent at any time.
Lawful bases. We process your personal information on these bases:
We rely on your consent for marketing communications. You may withdraw it at any time without affecting the messages we send about your orders and support enquiries.
International transfers. We are based in the United States. If you contact us or buy from us, your personal information is transferred to and processed in the United States. It may also be processed in other countries, including Canada, by our providers such as Shopify. Where we transfer personal information out of the EEA or UK, we rely on appropriate safeguards. These may include the EU-US Data Privacy Framework (where a provider is certified), the European Commission's Standard Contractual Clauses, and the UK's International Data Transfer Agreement or Addendum. You can ask us for more information about these safeguards using the contact details below.
How to exercise your rights. Contact us at service@eternate.com. We will verify your identity before responding.
Complaints. You have the right to lodge a complaint with your local supervisory authority. In the EEA, this is your national data protection authority. In the UK, it is the Information Commissioner's Office (https://ico.org.uk/make-a-complaint/).
We keep your personal information for as long as needed to fulfil the purposes described in this policy, after which we delete or anonymise it. These purposes include completing your orders, providing support, running the loyalty program, and meeting our legal, accounting, and tax obligations. Order records are typically retained for 10 years to meet tax and accounting requirements. You may ask us to erase your information at any time, subject to those legal obligations.
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information. Payment card data is handled by our PCI-compliant payment providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
The Site is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If you believe a child has provided us with personal information, please contact us at service@eternate.com and we will delete it. We do not knowingly sell or share the personal information of consumers under the age of 16. If we learn that we have done so, we will stop.
A cookie is a small amount of information that's downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don't have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance whether it's your first time visiting or if you are a frequent visitor.
We use the following cookies to optimize your experience on our Site and to provide our services.
Cookies Necessary for the Functioning of the Store
Reporting and Analytics
How long a cookie remains on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies last until you stop browsing. Persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.
You can control and manage cookies in various ways. Please keep in mind that removing or blocking cookies can negatively impact your user experience, and parts of our website may no longer be fully accessible.
Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser controls, often found in your browser's "Tools" or "Preferences" menu. For more information on how to modify your browser settings or how to block, manage or filter cookies, see your browser's help file or sites such as www.allaboutcookies.org.
Additionally, please note that blocking cookies may not completely prevent how we share information with third parties such as our advertising partners. To exercise your rights or opt out of certain uses of your information by these parties, please follow the instructions in the "Targeted advertising and your opt-out rights" section above.
Do Not Track. Please note that because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post the updated version here with a revised "Last updated" date.
